Four SANTA FE NEW MEXICAN Thursday, June 28, 192 SUES BANK FOR SUPREME COURT FUND OF $1,698 Claim Made State in Preferred Creditor for Money Deposited by Sena. A suit over Jose D. Sena's deposit in the Capital City bank, as clerk of the supreme court, was filed in Judge Reed Holloman's court by the state as plaintiff. Judgment is- asked against the bank. for $1,698.12, the amount of the deposit.

The 'action is based on the claim that the state is a preferred creditor and its claim ought to be paid in full out of the first available assets notwithstanding the claims of other creditors. The complaint was prepared by' Attorney, General M. J. Helmick and sistant Attorney General John W. Armstrong.

CLAUDE ROBERTS, NEW SINGER, DIES IN CALIPORNIA Albuquerque, N. June, Mrs. Claude 'Albright Roberta, daughter of Col. J. G.

Albright, of Albuquerque, died Thursday night at her home 'af St. Helena, Calif. Death was bellev. ed due to heart trouble, as recent attack of typhoid fever had left her with a weakened heart. The funeral is to be held here, though the time has not been nounced.

The body is expected to at rive here Sunday night, accompanied by Edward I W. Roberts, hasband. Mrs. Roberts, who Was widely known as the "New Mexico nightingale," was leading lady of the Paris Opera company, for a year. She was selected by Henry.

Askren, who participates in the prosecation of one Carl Magee, editor, in the district court of San Miguel county, stated explicitly, as We recall it, during his argument in the Parker libel case, that there was no politics involved in the case. It was very gratitying to have Mr. Askren make this clear.

And for that reason it would be extremely unfortunate if any hint of politics should creep in at this time. Accordingly, we aball call the attention of the scrupulous Mr. Askren to two things. The first is the meeting of the San Miguel County Bar association to receive charges submitted by Judge Clarence J. Roberta, against Judge Richard Hanna, charging the latter with unprofesstonal conduct in speech at Albuquerque.

Judge Hanna is counsel for Mr. Magee. We see a slight danger of apparent injection of politics in this matter. The Hat of Among Those Present, published in the Albuquerque Evening Herald, we note is composed of the following: Luis Armije, Republican, of the Magee case. 0.

well known, is a leading, promi nent, militant Democrat. It will thus. be clear to Mr. Askren and others who are deeply anxious to keep all taint of politics out of the situation, that grave danger of suspicion of such taint might arise were a Republican committee, appointed by a Republican bar association meeting, attended by numerous persons interested in cases against Magee, to investigate charges, filed by, a prominent Republican leader against a prominent Democratic This is so self -evident that we are sure the very of it will cause Mr. Askren to disapprove the whole proceeding, and exert his influence to have the committee at once discharged.

Otherwise the public would inevitably and most naturally believe that a political issue was involved. This might be a gross injustice to the undoubtedly conscientious gentlemen of the bar association, who perhaps, in their enthusiasm to maintain proper! respect for the courts, overlooked the political complexion of the meeting and the committee. As the association carefully refrained from passing on the charges during pendency of cases, in order not to embarass procedure, it was doubtless also much pained that an attorney injected such charzes into the situation during such pendency, and doubtless deplores the publicity given. All of this, of course, is irrespective of the merits of the case, into which we do not presume to enter. Understand, we do not imply that a Republican or a person connected wtih prosecttion of Magee is at all disqualified to pass upon the professional conduct of an attorney, but merely feel that for a prominent Democrat to be examined for disbarment by a body composed entirely of prominent Republicans would at once cause a lot of people to say unpleasant things, and bring in that real or fancied political element which we understand prosecution and court ace so anxious to keep out.

The second thing to which we wish to call the attention of Mr. Askren and the district attorney, is the case of the Las Cruces Citizen, a Republican weekly organ which has been convicting Mr. Magee while his case is still pending, with such statements as: "The evidence is all against "His charges wild and baseless" "His attacks are insane, untruthful, and blackmali "There is a cinch case against him," etc. We bave no brief whatever for Magee, of course, but it seems to us this smacks strongly of seeking to prejudice a pending case, which borders sometimes perilously on contempt of court. The "Citizen" also seeks to inject politics, as witness the following paragraphs: "Persons who put money into Mage's Tribune may see it all used for court He was and con.

The New Mexican has carefully refrained from saying of any reader regarding the Magee alleged libel and anything which might in any way, prejudice the opininn alleged contempt cases. It submits the foregoing wholly in the interest of unembarassment for, judicial procedure, and wholly without any political motive or any prejudice the cases at issue. upon which we expect to regarding comment when the proper time arrives.
